Missouri inmate convicted of killing cop says judges shouldn't get to hand down death sentences

A man awaiting sentencing for killing a Missouri police officer is challenging the constitutionality of a state law that allows judges to hand down the death sentence.A jury in June convicted 45-year-old Ian McCarthy of first-degree murder in the fatal shooting of Clinton Police Officer Gary Lee Michael Jr. during a 2017 traffic stop. After days of deliberation, the jury informed the judge that it couldn't decide between the state's only two sentences for first-degree murder: life in prison without parole or death.Missouri and Indiana are the only active death penalty states that allow judges to sentence people to die. Montana also allows judges to hand down death sentences, but it hasn't executed anyone since 2006.McCarthy's attorneys filed a motion last week asking a Jackson County judge to declare the state law unconstitutional and to sentence McCarthy to life in prison. With the Broncos short of playmakers heading into Sunday’s season opener against the Las Vegas Raiders, there was a glimmer of hope on Wednesday.Wide receiver Jerry Jeudy returned to practice after being sidelined for the last two weeks due to a right hamstring injury. Jeudy was in uniform, stretching and participating in individual drills during the media viewing of practice. Interstate 70 was briefly closed in both directions near Eagle today to a vehicle fire, according to the Colorado Department of Transportation.The department announced the closure on X, the social media site formerly known as Twitter, just before 2 p.m. The road was closed between Gypsum and Eagle at mile marker 143 and reopened at 2:15 p.m.This is a developing story and may be updated. Multi-Car Collision near Garden Highway Off-Ramp Left One DeadSACRAMENTO, CA (September 6, 2023) – A three-vehicle accident on Interstate 5 early Monday morning claimed the life of one person.The fatal incident happened around 3:10 a.m. along the southbound lanes of I-5, near the Garden Highway off-ramp.At this moment, the California Highway Patrol is investigating the reason that resulted in the crash. Rollover Collision near Bluff Springs Road Left Woman DeadAUSTIN, TX (September 6, 2023) – Saturday evening, a rollover crash on Slaughter Lane left one woman dead and another injured.The incident happened on August 26th, shortly after 10:02 p.m. on Slaughter Lane between Interstate 35 and Bluff Springs Road.According to reports, a pickup truck was traveling eastbound on Slaughter Lane. There, the driver lost control, crossed the lanes of the road, and rolled the pickup over.Emergency crews arrived at the scene shortly after and extricated two women from the wreckage.
